The Tyranny that is the Majority
Is the rule of the majority the rule of law? How easy would it be for the majority to overturn an existing law via an amendment? Are the rules of the new majority that is inconsistent with the existing law superior to the latter? Why does the system allows amendment of the laws by the current majority without scrutiny and approval by the court? What are the safeguards to prevent subjectivity in amending the existing laws viz a viz the constitutional limitations? The rule of law should promote order and genuine justice which may only be achieve when that law was enacted in a vacuum. That is, free of individual motive, moral biases, emotions and lies. But the latter are men's inherent characteristics. The same men who made up the majority that creates the rule that is the law. How can it be possible then to achieve a vacuum wherein a just law may be enacted? If it is not possible, then all laws made by men are tainted with biases, emotions, lies and personal motives.
